Terms and conditions

This is a translation of our Dutch privacy policy. In the event of any discrepancy, the Dutch version prevails.

These terms and conditions apply to all quotes, orders and deliveries by Pranger Kozijnen to consumers and business clients.

1. Who are we?

2. Quotes

Our quotes are without obligation and valid for 30 days, unless stated otherwise. The quote lists materials and labour separately, so you can see what you are paying for. Prices include VAT and include installation and removal of the old windows, unless stated otherwise. Dimensions in a quote made without a measuring visit are indicative; the final price is set after measuring.

3. Formation of the agreement

The agreement is formed as soon as you accept the quote in writing or by email. We then schedule the measuring visit. If measuring reveals that the situation differs from the assumption in the quote, we discuss this with you before ordering.

4. Prices, additional work and payment

The agreed price is fixed, except where additional work proves necessary. We never carry out additional work without your approval. We call you first, explain what is going on and what it costs, and only continue once you say yes.

We ask for a deposit. How much it is, when it is due and how the remaining payment is arranged are stated in your quote and on the invoice. Invoices are to be paid within the term stated on them. In the event of late payment we are entitled to charge statutory interest and collection costs.

5. Lead time and planning

Windows are made to measure; allow a few weeks’ production time after measuring. Stated periods are an indication and not a strict deadline. If production is unexpectedly delayed, we let you know as soon as possible, with a new date. Delay does not give rise to a right of rescission or compensation, unless there is intent or gross negligence on our part.

6. Carrying out the work

We carry out the work with our own fitters. You ensure the work area is accessible and clear, that we can use water and electricity, and that fragile items near the windows have been moved. We work with as little dust as possible, cover surfaces where needed and leave the work clean.

7. Permits and planning rules

You are responsible for any planning permission or aesthetic approval, for example for a listed building or in a conservation area. We are happy to think along and supply the technical details, but the application and any consequences rest with the client.

8. Completion and complaints

After completion we go through the work together. If you are not satisfied with something, let us know in writing within 14 days of completion so we can put it right. Minor colour deviations in uPVC, foil and glass compared with samples or images are inherent to the material and do not constitute a defect.

9. Warranty

We provide a 10-year warranty on the product supplied and on our installation, starting on the completion date. The manufacturer’s warranty against internal condensation applies to insulating glass. The warranty lapses in the event of improper use, alterations made by you, damage caused by third parties or failure to maintain the product as described in the maintenance instructions we provide. The warranty is not transferable without our written consent.

10. Liability

Our liability is limited to the amount paid out by our liability insurance in the case concerned, and otherwise to a maximum of the invoice value of the order. We are not liable for consequential loss, business interruption or loss of income. These limitations do not apply in the event of intent or wilful recklessness.

11. Right of withdrawal

If, as a consumer, you conclude an agreement away from our business premises, for example at your home, you have a 14-day cooling-off period. Because windows are made specifically to your measurements, that right of withdrawal lapses as soon as you have expressly asked us to begin production earlier and thereby waived your cooling-off period.

12. Retention of title

Materials supplied remain our property until the invoice has been paid in full.

13. Subsidy

We are happy to help you prepare your ISDE application and supply the required details. You submit the application to RVO yourself. We are not responsible for the award, the amount or the processing time of the subsidy; these are determined by RVO and the scheme may change or run out of budget.

14. Applicable law

Dutch law applies to all our agreements. Disputes are submitted to the competent court in the Gelderland district, unless the law mandatorily designates another court.
